1. Application

These Fair Usage Terms apply to the Customer’s use of any Service and prevail over the terms of the Agreement to the extent of any inconsistency. All defined terms in this Agreement apply to these Fair Usage Terms.

2. Fair Usage of Service Platform and Compute Resources

2.1 The Service provides powerful tools and resources to support various business-related activities. To ensure optimal performance and fair access for all users, these Fair Usage Terms outline the acceptable use of the Service and its compute resources. The Customer and End Users must utilize the platform in a lawful, ethical manner that aligns with Licensor guidelines and policies. This includes respecting the privacy and confidentiality of other users and the proprietary information they may access. The Customer and End Users must not do anything which impacts the security, confidentiality and/or integrity of the Service.

2.2 Resource allocation for users is based on subscription levels and project requirements, with specific quotas assigned for compute power, storage, and network bandwidth. The Customer and End Users must avoid activities that consume excessive resources, such as running tasks with infinite loops or using overly large datasets without authorization. Monitoring systems track resource usage to ensure compliance, and notifications will be sent if usage approaches allocated limits. Efficient data management, including regular backups and minimizing large data transfers during peak hours, is also essential. Only the Customer and End Users may access the Service.

2.3 When using the Service, the Customer and End Users are prohibited from engaging in any form of excessive resource consumption, unauthorized access to other users’ data or resources, and actions that compromise platform security. Engaging in such activities can lead to performance issues for other users and potential security breaches. The  Service uses robust encryption protocols to protect data and models, ensuring that all information is secure from unauthorized access and manipulation. Violations of these Fair Usage Terms may result in warnings, suspension of access, or termination of accounts. Customers and End Users are encouraged to report any performance issues, security concerns, or suspected policy violations to the Licensor support team promptly.

2.4 Regular reviews and audits ensure ongoing compliance with these Fair Usage Terms, and Customers and End Users will be notified of any significant changes.

2.5 By using the Service, Customers and End Users agree to adhere to these Fair Usage Terms.
